This Legal Topic Note relates to tenancies pursuant to the Agricultural Holdings Act 1986 (the 1986 Act). Most new agricultural tenancies will be subject to the Agricultural Tenancies Act 1995 which is covered in LTN 50. There are limited circumstances in which tenancies can now be granted pursuant to the 1986 Act (usually where a 1986 Act tenancy already exists) and councils should contact NALC for further details. Although not appropriate for tenancies which are wholly new, this Note will still be of relevance to those who have existing tenancies pursuant to the 1986 Act.

Community Right to Nominate and Bid for Assets of Community Value LTN85
The Localism Act 2011 gives parish councils the right to nominate an asset of community value to be added to a list maintained by their principal authority. If any listed assets comes up for sale, parish councils will be given a window of opportunity to express an interest in purchasing the asset and another window of opportunity to bid to purchase it. An asset of community value may include, for example, a community centre, village shop, tennis courts or a pub.

The Compulsory Purchase Act 1965 and the Acquisition of Land Act 1981 do not permit a local council to compulsorily purchase land. However, under s125 of the LGA 1972 Act it may request the relevant principal authority to do so on its behalf, if it is unable to acquire it by agreement and on reasonable terms.
